Independent Opinion and Expert Testimony

JDE has assisted parties involved with construction disputes by preparing independent opinions that may be used as a starting point for negotiation if JDE's opinion supports the client in ensuing negotiations.  Even if our view does not coincide with that of the client our involvement will still assist the client by forcing an in-depth review of the merits and quantum of the dispute and help with the decision whether to proceed further in the matter

As an example, JDE provided an opinion to a millwork subcontractor regarding the scope of work of the finishing carpentry versus the rough carpentry in a dispute worth approximately $15,000.  The millwork subcontractor submitted the JDE opinion to the general contractor (who undertook the rough carpentary).  The parties proceeded to negotiate a satisfactory settlement to our client.  This can be a very cost effective method in aiding the resolution of construction disputes - JDE's fees amounted to around 5% of the disputed amount.

Expert Witness Testimony

If the dispute proceeds through litigation or arbitration then there may be a need for expert witness testimony. JDE personnel have provided expert witness testimony in various jurisdictions and forums across Canada and the USA since 1984 on construction related issues.

Arbitration and Litigation Support and Exhibit Preparation

JDE is well placed to provide essential support to the arbitration and litigation process.  This support can range from assistance in the document and witness discovery process to in-house preparation of large colour presentation charts and photographs.
